Before the Administrative Court of Rhodes with a lawsuit against the Greek government as the successor of the Italian government, four Turks filed two new lawsuits in which they claim compensation related to de facto expropriation and the recognition of the nullity of the decrees of 13 May 1940 Italian governor for the expropriation of two plots of land in Niochori!!
As the local newspaper "Demokratiki" reported, with the no. 60 and 61/2022 decisions issued by the Administrative Court of Rhodes were deemed not to have been filed due to their incorrect service, the two lawsuits that they had initially filed.
The Turks filed lawsuits before the Court against the Greek State as the successor of the Italian State.
With the decisions no. 465 and 466/2022 of the Three-Member Administrative Court of Rhodes, the progress of the trial of lawsuits against the Greek State as successor to the Italian State brought by the 4 was suspended, until a final decision is published on similar lawsuits brought against the Greek State.
Over 100 Turkish NGOs have launched a legal campaign for the return of property, which they claim belonged to Turks who lived in the Dodecanese, especially in Kos, Rhodes, Western Thrace and Crete.
The issue, as announced by Turkish media, will be transferred through the Turkish associations to the United Nations, the EU, the OSCE and the ECHR. This is a new example of Turkish provocation that manifests itself at all levels.
With the one lawsuit before the Court of Rhodes, the first is claiming €2,848,076.3 and the others €632,905.3 each. With the second, the first claims only compensation in the amount of 949,358.3 euros.
They allege that the expropriations were illegal and seek the annulment of the aforesaid decrees, and since the return of the aforesaid rates is impossible, as the aforesaid properties have already been sold to bona fide third parties and constituted new portions, they request that they be awarded compensation, which consists of the present commercial value, which all properties have since, as they claim, it is impossible to estimate the then value of these properties.
